The standard rule under 9 V.S.A. 4461 gives 14 days from the date the tenant vacated, where the landlord had notice of that date, or from the date the landlord discovers the unit was vacated or abandoned. For seasonal occupancy of a dwelling not intended as a primary residence, the period is 60 days. That is a fourfold difference driven entirely by the character of the letting.
Burlington portfolios frequently contain both, and the classification is not always obvious. A unit let to a student for the academic year, a property used as a second home and let in between, and a conventional year-round tenancy can sit in the same building. The classification has to be recorded at tenancy level, because at move-out the question is not what the property usually is but what this particular letting was.
Getting it wrong in the safe direction still costs. Applying 60 days to a unit that was actually a primary residence forfeits the right to withhold any portion of the deposit, and Vermont's forfeiture is absolute rather than proportionate. Applying 14 days everywhere is the conservative error and the one we default to where classification is genuinely unclear.

The fourfold difference between the two deadlines is decided by the character of the LETTING, not the property: seasonal occupancy of a unit that is not the tenant's primary residence. Owners routinely describe a property as seasonal because that is how THEY use it, then apply 60 days to a tenant who lived there as their only home, producing a return 46 days late under the rule that actually applied. Classification belongs to the tenancy and should be recorded at letting, not decided at move-out.
