Kansas forfeits the landlord's right to retain any part of the deposit for missing the 30-day deadline or failing to provide the itemised statement. That is an all-or-nothing consequence, so a legitimate eight hundred dollar deduction on a modest deposit disappears entirely over a paperwork failure, and the landlord can additionally face one and a half times the wrongfully withheld amount plus costs and fees.
The economics are worth stating plainly, because they explain why the discipline matters in a low-rent market rather than despite it. On a small deposit the recoverable damage is often close to the full amount, so the forfeiture is effectively total. There is no partial credit for having been substantively right.
Documentation is what prevents that. Each deduction should tie to a dated record of the condition and the cost, because an itemised statement is not a list of amounts, it is a list of amounts with a basis. We build the move-out file as the work happens rather than assembling it when a dispute arrives, at which point the evidence either exists or it does not.
Kansas K.S.A. 58-2550 requires return of the refundable portion and an itemised written statement of deductions within 30 days of the tenant surrendering possession. Missing either forfeits the right to retain ANY part of the deposit, and wrongful withholding exposes the landlord to one and a half times the amount plus court costs and reasonable attorney fees.
Kansas sets the maximum deposit by FURNISHING: up to one month's rent for an unfurnished unit and up to one and a half months for a furnished one. That makes furnishing status a compliance attribute of the tenancy rather than a marketing detail, and because a unit can be let furnished one year and unfurnished the next, it has to be dated against the lease rather than flagged statically on the property.
