A landlord holding a deposit for a year or longer pays interest at a rate equal to that paid on regular savings accounts at the New Hampshire bank, savings and loan, or credit union where it is deposited. So two portfolios with identical deposits owe different amounts depending on where they bank, and a change of institution changes the obligation going forward.
That means the rate has to be evidenced from the account rather than assumed. We record the applicable savings rate alongside the deposit ledger and refresh it when it moves, because a calculation resting on a remembered or estimated rate is not supportable and the tenant is entitled to what the account actually pays.
The one-year threshold makes tenancy length the trigger, so a portfolio has deposits accruing interest and deposits not accruing, side by side, and the boundary moves as tenancies mature. Return of the deposit and payment of the interest due are both required within 30 days of termination, with a written itemised list of any damages claimed.
