The pattern is familiar: the unit is inspected when convenient, a contractor is called, and by the time a figure exists the deadline has passed. The deposit is then returned late with a deduction that was substantively reasonable and procedurally indefensible.
The answer for a small portfolio is not a heavier process, it is a shorter one. Inspect at handover, decide the deduction from a pre-set schedule rather than waiting for a quote, and pay within the fortnight. Refinement can happen afterwards; the payment cannot.
The request-driven itemisation then works in the landlord's favour, since the 45-day window to produce it is generous. But it only helps if the underlying decision was recorded when it was made, because a written accounting produced from memory six weeks later is exactly the document that invites a challenge.
South Dakota splits the obligation into two events on very different clocks. The deposit is returned within TWO WEEKS of the tenant moving out, among the shortest payment deadlines anywhere. A written itemised accounting of deductions is only required if the TENANT REQUESTS it, and then within 45 days of that request, among the longest. Payment and explanation are triggered by different events.
The cap is one month's rent, with a larger amount permitted by AGREEMENT where special conditions pose a danger to maintenance of the premises. That is a narrow permission, not a general licence to charge more for a tenancy considered risky, and the agreement itself does not cure a misuse of it, so the specific condition relied upon belongs in the record alongside the amount.
